Guys...calm down. There are countries that don't give a damn about gamefreak's claimes... and as it was stated before, the server is located in one of those countries. Stop speculating or creating "what if"-scenarios that will not occurt anyway and simply enjoy & support the game. I know fan made games that are running servers in the same environment and they have been running for more than 8 years so far.

Copyright law is a very interesting (and shady) topic if you're a lawyer.

Basically in some countries you don't break the copyright if what you're doing is free and only accept donations. PRO is free becasue it doesn't produce profit for the staff and only acccepts donations which it spends on maintaining itself.

Also, to be more secure, Pokemon MMOs are never leave the "beta" phase as in most of the countries only the final product can break copyright law, so as long as the game is "unfinished", it can't be considered as a law-breaking product.

That's how all the Pokemon MMOs work and Nintendo and GameFreak can do not much to stop them. They found a way in the past however, naming their officially licensed game Omega Sapphire they forced Pokemon Omega to be closed because the naming was too similar.

So, you're saying that if Gamefreak decides to release a Pokemon Revolution for example then thats the only way they could shut down this server?

No, the game is not licensed and probably never will be. The best things they can do is host it in another country with different laws (Which they already said they are) and not give out personal detail such as names, skype names, anything identifiable or else they can be caught quite easily.

That is an interesting topic as well. Interestingfly international law practice (and thus national law) doesn't forbid similar names, but forbids names that can confuse customers.

 

For example if you have a Skynet Ltd. then a Sky-Net Ltd. name would be too similar to steal your customers, especially if the main profile of the two companies are similar or the same, but a Skynet Marshmallows Ltd. would be acceptable. A NetSky Ltd. would also be acceptable.

 

With PRO and Pokemon Battle Revolution the trick is that the so-called "lead word" after the - let's say - "brand name" (which is Pokemon) is different. In case of our game the lead word is "Revolution" while in the other case is "Battle". The lead word is very important because it helps to distinguish the two games.

The law doesn't forbid to have similar names or have the same words in the name of the games, as long as it is clear enough that they are completely different products.

 

Pokemon Omega's demise was that Omega was the lead word of both games and they both were generic Pokemon games (you walk around, collect Pokes and battle with them).

PRO will be in trouble if GameFreak announces a Revolution Gold and Liberation Silver or something like that.
