I have over 9000 excavs, but i still sometimes smash things and can't get them, is this a bug? Or are there some special items which i need to have a real ton of excavs to get them?

You got a pick axe ? If you don't, you cannot get anyting from the shiny stones.

i have ms, pickaxe and what i thought it was the minimum excavs to get everything possible from them, and i still smash things

Probably there is a probability of success, I've tried to uncover the fossils with the toothbrush many times and all of them are useless rocks x)

but that is a different thing, in that case (that i havent been able to get any fossil successfully) i get the option to choose what to do, but in this case i am just told that i have smashed something dont know why
